A lawsuit was filed in early 2024 by a Sea Island resident, and a Brunswick resident against the Sea Island corporations, and county officials, declaring the Glynn County abandonment of the roads years earlier was illegal. The plaintiffs sought relief in the form of rendering the change of ownership contracts illegal, and the return of the roads to the citizens of Glynn County. The removal of the gate house was also sought.
The case was moved to Federal court by the defendants for dismissal in March of last year, causing the plaintiffs to ask the case be remanded back to the local jurisdiction.
Yesterday, the United States Court for the Southern District of Georgia, Brunswick Division, agreed and remanded the case back to the Superior Court of Glynn County. The order is below.
Sources tell The Georgia Record the timing of the development is curious as there is a fight ongoing in the county over a roundabout construction at the intersection of Sea Island road and Frederica Road. The County is considering using eminent domain to force sale of land from the St. Simons Land Trust.
