Sea Island Plaintiffs Appeal Loss Of Road Abandonment Case

Plaintiffs in the legal action against Glynn County in the Sea Island case which seeks to reverse what the plaintiffs call 'road abandonment' by the County to the Sea Island corporation years ago, lost a GA Appeals Court ruling this week. However, plaintiffs have now filed an intent toappeal to the Georgia Supreme Court.

The adverse ruling this week to the plaintiffs centered on the issue of 'sovereign immunity'. Two of the three judges involved in the ruling declared the county can do whatever it wants, if the county wants to give public infrastructure to a private entity, it can do so. The sole dissenter was Judge McFadden.

The notice to appeal in Atlanta for the road abandonment and the state properties was made formally yesterday.
