    GA Candidates Sue Raffensperger to Enforce Public Election Laws

    ATLANTA, GA. MAY 19, 2026 – Three Georgia candidates have filed a writ of mandamus petition against Secretary of State (SOS) Brad Raffensperger seeking to force him to perform his duties for the May 19 primary in public as required by law. The petition includes an emergency motion for a temporary injunction to allow State Election Board members to be present for Election Night results aggregation that occurs at an Emergency Operations Center in a “secret bunker” run by the Georgia Emergency Management Agency. O.C.G.A. § 21-2-406.


    The petitioners are 11th District U.S. Congressional candidate Chris Mora of Pickens County, State Senator Greg Dolezal, a Forsyth County resident who is running for Lieutenant Governor, and Keli Gambrill, a Cobb County Commission candidate. They are represented by attorney David Oles.

    Their action is bolstered by 14th District U.S. Congressman Clay Fuller who has written a letter to Committee on House Administration Chairman Bryan Steil. It requests that he “designate appropriate congressional election observers to monitor all elements of the Secretary of State’s election reporting process, including the Election Night Reporting Room which is currently being closed to members of the State Election Board.” Congressman Fuller’s request was issued pursuant to the Confirmation of Congressional Observers Access Act.52 USC § 21083a.

    The candidates filed their action in Fulton County Superior Court, the home of the Georgia state government where all Georgia election matters are required to be filed. Although county courts are supposed to have a judge available for emergencies such as malfunctions that require poll operations to be extended, the assigned Judge Melynee Leftridge indicated she will not be available today and counsel for Secretary Raffensperger has demanded five days to respond. Attorney Oles has indicated he will seek an ex-parte decision from chief judge Ural Glanville since all candidate petitioners will suffer irreparable harm in a delayed decision.

    Raffensperger ignored his own conflict of interest as a gubernatorial candidate and instead attacked Senator Dolezal in an 11Alive interview. He claimed: ”…you’d think Senator Dolezal would know that votes are not counted in the Secretary of State’s Emergency Operations Center.” VoterGA co-founder Garland Favorito responded: “That is a false argument. Statewide votes are verified, aggregated, and reported from a secret bunker and the secrecy has to stop. This is a federal election and we are requesting immediate DOJ intervention to protect the voting rights of all Georgians and uphold our election laws.”
