In a much anticipated ruling from Colorado appeals court Tina Peters case has been sent back to the trial court to be resentenced.
While the judgement of conviction was upheld, the sentencing was reversed. The Appeals panel cited “improper consideration of her exercise of her right to free speech."

Following Tina Peter’s conviction, many have questioned the statements and decisions of trial judge Matthew Barrett, both during the case and during her sentencing.
In oral arguments before the appeals court, attorneys for Tina Peters noted flaws in the language and structure of certain charges against her along with concerns regarding the jury's access to certain exonerating evidence.
In recent weeks, Colorado Governor Jared Polis had signaled a growing sensitivity to Tina Peter’s 9 year sentence, especially in light of other similar cases which received community service or probation, in some cases with little to no actual prison time.
